ATA law for private sector deemed unconstitutional

The debate over the Automatic Price Adjustment (ATA) has taken a new turn after a legal opinion concluded that any law enforcing ATA in the private sector would be unconstitutional.

The opinion, commissioned jointly by the Cyprus Chamber of Commerce and Industry (CCCI/KΕΒΕ) and the Employers and Industrialists Federation (OEB), was prepared by constitutional expert Achilleas Emilianides.

According to a joint announcement, the document has already been forwarded to the president of the republic.

“CCCI and OEB jointly requested and obtained a legal opinion from constitutional lawyer Mr. Achilleas Emilianides on the matter of legislating ATA in the private sector,” the statement said.

“The legal opinion, which concludes that such a law would be unconstitutional, has been sent to the president of the republic and is now being made public.

“CCCI and OEB express disappointment and deep concern over the unilateral handling of this issue and call on the government to remain committed to the system of tripartite cooperation and the Industrial Relations Code.

“If, against all expectations, the government chooses the legal route, labour relations will move from negotiation and cooperation to the courts and litigation.”
