Supreme Court decision on new application

A new request by suspended Metropolitan Tychikos to submit a supplementary affidavit has been rejected by the Supreme Court ruling.

The Tychikos court ruling concerns an application seeking permission to file proceedings to annul a decision by the Holy Synod of the Church of Cyprus, dated January 8, 2026, which imposed an indefinite suspension on him.

Legal challenge against Church decision

In his original application, Tychikos sought leave to file for annulment through a writ of certiorari. He also requested a mandamus order to compel the Holy Synod to provide documents on which the decision against him was based.

Additionally, he requested a prohibition order to halt any further procedures for filling the position of Metropolitan of Paphos, as well as to suspend any further sessions of the Holy Synod concerning matters related to him, until the legal process is completed.

Supplementary affidavit request rejected

Following the initial filing, Tychikos submitted a new application seeking permission to file a supplementary affidavit to support his case.

According to his sworn statement, the request aimed to inform the Court that, in the interim, a decision had been issued on March 12, 2026, by the Ecumenical Patriarchate regarding his appeal, which was ultimately rejected.

Court reasoning and limitations

In its decision, the Court noted that while there was no delay in submitting the request, the proposed supplementary affidavit sought to introduce facts that arose after the original decision of the Holy Synod.

It further stated that the outcome of the appeal to the Ecumenical Patriarchate, as well as the applicant’s complaints regarding the process and alleged lack of proper reasoning, could not be examined within the framework of the current proceedings.

The Court emphasised that the scope of the procedure for granting leave is strictly defined and limited to examining the earlier decision of the Holy Synod dated January 8, 2026.

Application dismissed

The Court concluded that including subsequent developments, which are not directly linked in a meaningful way to the issues under consideration, is not justified within this process.

As a result, the request to file a supplementary affidavit was rejected.
