Sentencing hearing postponed for British man over death of 3-year-old

The child death case involving a 37-year-old British man was adjourned for one day on Monday after his defence requested additional time to submit documents ahead of sentencing.

Defence seeks additional documents

The 37-year-old appeared before Paphos District Court on Monday for mitigation submissions. His lawyer, Alexandros Alexandrou, requested an adjournment until Tuesday to allow further documents to be submitted in support of the written mitigation plea.

The defence intends to present factors and reasons it says should be taken into account by the court when determining the sentence, with a request for the minimum applicable penalty.

According to the defence, a document from the defendant’s workplace concerning his professional competence and other related matters could not be obtained in time because of the time difference with the UK and the weekend.

Hearing set for Tuesday

The court granted the one-day adjournment. The prosecution did not object to the request.

The case was rescheduled for Tuesday at 10:30am.

During Tuesday’s hearing, the prosecution is expected to first outline the facts of the case. The defence will then submit its written mitigation plea and supporting material, followed by oral submissions.

Defendant has pleaded guilty

The 37-year-old has already pleaded guilty to the charge of causing the death of his three-year-old son through a reckless, thoughtless or dangerous act.

The case concerns the death of the boy after he fell from a height of around 10 metres from the fourth floor of a hotel in Paphos on the first day of the family’s holiday in Cyprus.

The court has previously ruled that the defendant should remain free under the same conditions.
