New EU rules target influencers – What applies to Cyprus

European Audiovisual Observatory report commissioned by the EU Commission charts fragmented national influencer regulations across social media, revealing soft-law via consumer protection, AVMSD, DSA, GDPR, UCPD, with France and Spain having the sole legally binding definitions treating many as traders even sans media provider status.

Influencers qualify AVMS providers if content forms the main part, targeting a broad audience with editorial responsibility, revenue intent, regular frequency, high reach online distribution; exclusions: Switzerland, UK, quantitative thresholds, Spain, Italy, Netherlands, others.

Cyprus framework details

Cyprus lacks a legal influencer definition, but CARO’s Influencer Marketing Guide covers human virtual personas on Facebook, Instagram, TikTok, and YouTube, defining independent third-party influencers by audience impact regardless of label size, though reach factors violations. Article 2 Radio TV Law extends AVMS to influencers with editorial stable frequency, broad impact, informational, entertainment, and educational aims, sans CRTA registration precedent.

CPS enforces via the 2021 Consumer Protection Law, UCPD transposal deeming undisclosed commercial intent misleading; CARO-CPS 5-year MoU March 2024 co-regulates transparency, clear, conspicuous, understandable, ad labeling educating businesses, public creators pre-violation.

2026 expectations

Report highlights rising accountability, Italy AGCOM redefines Spain CNMC Autocontrol co-regulation, UK FCA finance influencers; 2026 eyes AI deepfakes, political ads, minor protection. Cyprus Prof Achilleas Emilianides UNIC Law DeNew EU Rules Target Influencers and contributed to national rules verification.

Influencers’ ignorance risks fines, corrective posts, jail, and severe breaches like France’s DGCCRF 60% violations since 2021.
