Commissioner finds direct discrimination
The Commissioner for Administration, Maria Stylianou-Lottides, has ruled that the State Health Services Organisation (OKYPY) directly discriminated against a kitchen worker at Makario Hospital because of her disability.
In a report released on 5 December 2025, the Commissioner recommends that OKYPY immediately provide reasonable adjustments in the form of modified duties for the employee.
Medical evidence ignored
Medical certificates submitted by the worker confirm that her current health condition prevents her from performing her assigned tasks. Doctors specifically advise against heavy lifting and prolonged standing, warning that such conditions could lead to serious complications.
Despite being aware of these certificates, OKYPY has refused to make any adjustments. The Commissioner notes that the organisation has repeatedly questioned the validity of the employee’s health issues and attempted to undermine her claims, creating an atmosphere of pressure and intimidation.
Internal regulations misused
OKYPY argued that changes in duties are only possible through recruitment to a new post or following a Medical Board decision. The Commissioner rejected this position, stating that the worker is not seeking promotion but reasonable accommodation as a person with disability – a legal entitlement separate from internal transfer rules.
The refusal to modify duties, at least until a Medical Board assessment, prevents the employee from enjoying equal working conditions and constitutes direct discrimination on grounds of disability, the report concludes.
Recommendations and next steps The Commissioner formally recommends that OKYPY:
- immediately reassign the worker to suitable lighter duties matching her medical needs
- continue the adjustment at least until the Medical Board issues its decision
A meeting with OKYPY’s General Executive Director has been scheduled for 9 December 2025.
