Medical negligence case filed over missed cancer diagnosis

A lawsuit has been filed at the Nicosia District Court against a private diagnostic centre and a doctor, alleging medical negligence that led to a delayed cancer diagnosis and ultimately the death of a patient.

According to the claim, the woman underwent an abdominal and pelvic MRI in November 2021. Despite imaging data, the medical report described her pancreas as “unremarkable,” with no findings requiring further investigation.

Nearly two years later, in July 2023, a new scan at the same centre- by the same doctor- revealed a lesion in the tail of the pancreas, larger compared to 2021 images, and signs of metastasis in the peritoneal cavity. An urgent biopsy confirmed advanced pancreatic adenocarcinoma. The patient underwent extensive treatments and surgeries.

Independent doctors who later reviewed the original 2021 scans reportedly identified a visible mass with malignant characteristics, which could have led to earlier diagnosis and potentially successful surgical treatment.

The plaintiffs argue that the misinterpretation of the first scan constituted serious medical negligence, depriving the patient of valuable time and chances of recovery. They also cite the suffering caused by prolonged illness, intensive therapies, pain, and emotional strain, and the profound impact of her loss on her family.

Responsibility is attributed both to the doctor who issued the report and to the diagnostic centre, accused of failing to ensure proper standards of care. The lawsuit details omissions and breaches of professional duty, alleging the defendants did not act as other competent doctors would have in the same situation.

The case remains at an early stage, with the defendants expected to file their response. The plaintiffs are represented by Papantoniou & Papantoniou law firm.
