Court dismisses legal aid application in arrest warrant dispute

Application for Certiorari dismissed

The Administrative Court in Cyprus has rejected an application for legal aid, which was submitted by a citizen seeking to file a Certiorari application to annul an executed arrest warrant.

The decision was issued on the same day by Judge Ioannidis, who ruled that the request did not fall within the provisions of the relevant legal aid legislation.

The case concerned an attempt to challenge an already executed arrest warrant through the issuance of a prerogative order of Certiorari.

Applicant’s financial status examined

During the proceedings before the Administrative Court of Cyprus, the applicant stated that he was unable to work and received a disability pension at 75%.

He also reported that he had no movable or immovable property, apart from a 30-year-old vehicle.

However, the court found that the key issue in the legal aid request was not the applicant’s financial situation, but the purpose of the application itself.

Arrest warrant and background case

Court records showed that the arrest warrant was issued on 6 February 2026 and executed on 13 February 2026 at Larnaca International Airport.

It related to an alleged common assault case involving a Social Welfare Services official at the Ministry of Health.

According to testimony presented in court, the applicant had visited the Ministry demanding payment he believed he was owed following a medical procedure abroad.

The situation allegedly escalated, resulting in the applicant being accused of assaulting a public officer after a confrontation.

The applicant has denied the allegations, describing them as “fabrications”.

Legal reasoning and dismissal

The court ruled that Certiorari proceedings are civil in nature and not covered by the Legal Aid Law 165(I)/2002.

It also referenced earlier case law, including a ruling by Judge Santis in application No. 80/2021, which clarified the legal classification of such procedures.

The court emphasised that the legal aid framework does not extend to applications seeking prerogative remedies of this nature.

As a result, the application was dismissed in full.
